Partnership Disputes
Two or more people who work together in a business they own collectively are in a partnership. Partners that have taken legal advice at the outset of forming the business would usually draft a Partnership Agreement setting out the terms of their business relationship. However many Partners set up businesses based upon mutual trust.
Many of the most successful businesses are founded by the strong relationship between two or more partners or shareholders.
However if the relationship breaks down, the financial implications for all of the partners can be devastating. The dispute could lead to the dissolution of the Partnership which can destroy the business and result in substantial tax disadvantages for all partners. Partners are jointly and severally liable to third parties in respect of business debts and third party funding.
We can provide experienced advice from the outset of any dispute to assist the continuance of the Partnership or the separation of the Partners business and financial interests.
