Pre-nuptial Agreements

Although pre-nuptial agreements have no legal status in this country, they are becoming increasingly common, particularly where there are substantial means or for a second marriage where one party wishes to protect their assets for the benefit of children of an earlier relationship.

Whilst pre-nuptial agreements are not legally binding, it is apparent from recent reported cases that the Judges are beginning to attach more weight to agreements freely entered into by parties, prior to their marriage, where there are no children and both parties have received independent legal advice.
