Depending upon the date of birth of a child, if the parents were not married at the time, the father will not automatically have Parental Responsibility in respect of the child. We can advise upon how unmarried fathers can obtain Parental Responsibility which include all of the rights, duties, powers, responsibilities and authority, in respect of the child; for example care and control of the child, decisions regarding education, religious upbringing, medical treatment, removal out of the jurisdiction and the child’s surname. We can also advise and represent a parent of a child in the event of an issue arising regarding any of these matters.
In the event of a marriage breakdown or separation we can help in disputes regarding children; for example, where a child is to live or the extent of any contact between the child and the other parent. It is always better for parents to reach agreement in relation to children between themselves, however, this is not always easy, particularly in the midst of an acrimonious divorce. We always regard Court proceedings in respect of children as a last resort. The welfare of the children must always remain the paramount consideration.
