Automatic Discharge

In normal circumstances, on a first bankruptcy, after 12 months the bankrupt is automatically discharged. However, in certain circumstances for example, where a bankrupt fails to cooperate with the Official Receiver and/or Trustee, application can be made to the Court, for an order suspending the discharge until the end of a specified period or the fulfilment of a specified condition (s279(3) Insolvency Act). If granted, the bankruptcy and associated restrictions remain in force until the conditions in the order are fulfilled or further order.
